1. Scope of application

The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is aimed exclusively at consumers residing in Switzerland who have reached the age of 18 (hereinafter ‘customer’). Persons under the age of 18 are not authorised to use or order via this website.

A consumer is a natural person who maintains a business relationship with Ayuviva that cannot be attributed to their commercial or independent professional activity. Orders in non-household quantities may be rejected without justification.

Ayuviva reserves the right to amend these GTC at any time. The version of these GTC valid at the time of the order shall apply. Conflicting or deviating conditions of the customer are not recognised.

The operator of this website is Ayuviva, E-Commerce Gunawardena, Glärnischstrasse 6, 8853 Lachen, Switzerland (see imprint).



2. Information on this website

Ayuviva provides information about products and services. Prices, product ranges and technical specifications are subject to change without notice. All information on www.ayuviva.ch (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are for illustrative purposes only and are to be understood as approximate values. They do not constitute an assurance of properties or guarantees, unless explicitly stated otherwise. Ayuviva endeavours to ensure that all information on this website is correct, complete and up-to-date, but cannot provide any guarantee.

All offers on this website are subject to change and are not to be understood as binding offers.

Ayuviva cannot guarantee that all products listed will be available at the time of ordering. Availability information and delivery times are without guarantee and can be changed at any time.



3. Prices

The sales prices stated on Ayuviva are final prices and include VAT and all other taxes. The prices are in Swiss francs (CHF).

Additional shipping costs are calculated separately and shown in the order process. Technical changes, errors and misprints excepted. Consultancy and support services are not included in the price.



4. Conclusion of contract

The products and prices offered on this website are non-binding offers.

By placing an order and accepting the GTC, the customer submits a binding offer to conclude a contract. After receipt of the order, Ayuviva sends an automatic order confirmation by e-mail. Orders placed are binding for the customer, unless a right of cancellation is expressly provided for.

The contract is concluded as soon as Ayuviva sends a dispatch confirmation by e-mail. Orders are only dispatched after receipt of payment and availability of the goods.

If ordered goods are not available, the customer will be informed by e-mail and payments already made will be refunded.



5. Payment options and retention of title

The customer has the payment options specified in the order process at his disposal. Ayuviva reserves the right to exclude customers from certain payment options or to insist on payment in advance. In the event of late payment, Ayuviva may charge interest on arrears of 5% per year and a reminder fee of a maximum of CHF 20 per reminder.

The delivered products remain the property of Ayuviva until full payment has been received.



6. Delivery, obligation to inspect, notification of defects and returns

Deliveries are sent to the address specified by the customer. Ayuviva endeavours to keep delivery times short. Delivery times are non-binding. The customer is obliged to inspect the goods on receipt and to report any obvious defects in writing within 5 days.

Returns are at the expense and risk of the customer. All defects must be described in detail and the goods must be sent to the return address in their original packaging and with the delivery note.



7. Right of cancellation

The customer is granted a voluntary right of cancellation of 14 days from receipt of the goods. The goods must be returned in their original packaging, complete and accompanied by the delivery note. The customer shall bear the return costs. A refund will be made within 14 to a maximum of 30 days after receipt of the returned goods or presentation of proof of dispatch.

In certain cases there is no right of cancellation, e.g. for perishable goods, customised products or digital content without a fixed data carrier.


8. Warranty

Ayuviva endeavours to deliver goods of impeccable quality. For defects that exist upon receipt of the goods, Ayuviva assumes the warranty for the statutory period of two years. It is at the discretion of Ayuviva to fulfil the warranty by replacement delivery, price reduction or - if the goods are returned - by refunding the purchase price.

Excluded from the warranty are:

• Defects caused by improper storage or handling on the part of the customer,
• natural wear and tear,
• products with an expired best-before date and
• defects in consumables and wear and tear products (e.g. teas, spices) whose quality and properties may change if stored improperly.

9. Liability

Ayuviva excludes any liability for indirect damages and consequential damages. Further legal liability remains reserved.



10. Data protection

Details on the processing of personal data can be found in the data protection provisions.



11. Partial invalidity

Should individual provisions of these GTC be invalid, the remaining provisions shall remain valid.



12. Place of jurisdiction and applicable law

Swiss law is exclusively applicable, and the UN Convention on Contracts for the International Sale of Goods is excluded. The place of jurisdiction is Lachen SZ or the customer's place of residence.
